1. Acceptance of Terms
By accessing and using Case Management Recruiter's website, you accept and agree to be bound by these Terms of Service.
2. Nature of Our Services
Case Management Recruiter is a recruitment and candidate sourcing firm. Our role is limited to identifying, vetting, and presenting qualified candidates to healthcare organizations. We do not make hiring decisions. All hiring, employment, compensation, and termination decisions are made solely by the employer. The employer is responsible for conducting their own interviews, reference checks, background checks, credentialing, and final suitability determinations before extending an offer of employment.
3. No Warranty or Guarantee of Candidate Performance
Case Management Recruiter presents candidates based on our professional assessment of their qualifications, experience, and stated credentials. However, we make no warranty, express or implied, regarding the performance, competence, character, fitness, or suitability of any candidate we present. We do not guarantee that any candidate will accept an offer, remain employed for any specific duration, or achieve any particular operational or financial results. The employer assumes full responsibility for all employment decisions and outcomes.
4. Employer's Independent Obligations
The employer agrees to independently verify all candidate credentials, including but not limited to licensure, certifications (CCM, ACM, RN, LCSW, or otherwise), employment history, references, criminal background, and clinical competence before making a hiring decision. Case Management Recruiter is not responsible for any loss, damage, or harm arising from the employer's failure to independently verify candidate qualifications.
5. Limitation of Liability
To the fullest extent permitted by law, Case Management Recruiter, its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of revenue, profits, or data, arising from or related to the presentation, referral, or placement of any candidate, or from any hiring decision made by the employer. The employer acknowledges that Case Management Recruiter's sole obligation is to present candidates for the employer's independent evaluation. Our total liability for any claim arising from our services shall not exceed the fees paid to us for the specific search engagement giving rise to the claim.
6. Indemnification
The employer agrees to indemnify and hold harmless Case Management Recruiter from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from the employer's hiring, supervision, or termination of any candidate we present, or from the employer's failure to conduct independent verification of candidate qualifications.
7. Privacy
Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices.
8. Intellectual Property
All content on this website is the property of Case Management Recruiter and is protected by intellectual property laws.
9. Governing Law
These Terms shall be governed by the laws of the State of Tennessee, without regard to conflict of law principles.
